Jail inmate alleged that correctional officers failed to keep him safe and failed to prevent a fight after a “rival” inmate was let into the same day room. Michael Condon and Jason Rose successfully filed a motion for summary judgment for the officers. In granting the motion, the court ruled that the inmate could not show that the officers acted with “deliberate indifference” – since both the officers and the plaintiff were surprised by the “rival” inmate’s attack. James v.
